Terms of Use of the iApply Platform

Public Offer

This document constitutes an official public offer (hereinafter referred to as the “Offer”) in accordance with Articles 367 and 369 of the Civil Code of the Republic of Uzbekistan and establishes the procedure for using the services of the iApply.org platform (hereinafter referred to as the “Platform”) provided by TA’LIM PORTALI LLC (hereinafter referred to as the “Operator”).

By accessing or using the Platform, the user fully and unconditionally agrees to the terms of this Offer.

1. TERMS USED

1.1. The following terms are used in this Offer with the following specific meanings:

Operator"TA’LIM PORTALI" LLC — the owner of the Platform and the legal entity providing services.
UserAn individual who has registered on and uses the Platform.
Educational InstitutionA foreign or local higher educational institution to which the User submits documents.
Personal AccountA dedicated section of the Platform provided to an authenticated User, allowing them to manage their personal data, applications, and payments.
AuthenticationThe process of a User verifying their identity via login and password or other means.
PaymentThe transfer of funds by the User for Platform services.
Personal DataName, surname, phone number, email, passport details, and other identifying information provided by the User to the Platform.
MentorAn individual registered on the Platform who provides educational advisory and guidance (mentoring) services to users.
Mentoring ServiceAdvisory, guidance, and monitoring services in the field of education provided by a Mentor to users through the Platform.
Mentoring PackageA service package created by the Mentor through their Personal Account and approved by the Operator, including a description, scope, duration, and price of the mentoring service.
CommissionA percentage-based fee withheld by the Operator from the mentoring payment for Platform services.

2. GENERAL PROVISIONS

  • This Offer defines the terms of use of Platform services between the Operator and the User.
  • The Offer is public. Its terms apply equally to all Users.
  • Platform operations are conducted in accordance with the current legislation of the Republic of Uzbekistan.
  • Accessing or using the Platform constitutes the User’s full and unconditional acceptance of the terms of this Offer.
  • If the User does not agree to the terms of the Offer, they must not use the Platform.

3. SUBJECT OF THE OFFER. SERVICE COMPOSITION

3.1. The subject of this Offer is the provision by the Operator to the User of the following services through the Platform:

  • Providing information about foreign and local higher educational institutions
  • Enabling online submission of applications and documents
  • Tracking the process of document receipt and review
  • Providing additional consulting and technical support
  • Enabling payments

3.2. Some types of services (e.g., express document delivery, consultations) may be paid. The list of paid services and their rates are announced separately on the Platform.

4. ACCEPTANCE PROCEDURE (ACCESSION)

4.1. The User’s full and unconditional acceptance of the terms of this Offer is confirmed by performing one of the following actions:

  • Registering on the Platform (filling out the form and clicking the "Register" button)
  • Practically using the Platform’s services
  • Checking the box "I have read and accept the terms of the public offer"

4.2. From the moment of accession, the User is deemed to have accepted the terms of the Offer and taken on the obligation to comply with them.

4.3. To register, the User must provide their active phone number and email address.

5. RIGHTS AND OBLIGATIONS OF THE PARTIES

5.1. The User has the following rights:

  • Use the Platform’s services
  • Access and update their personal data
  • Submit documents to educational institutions through the Platform
  • Obtain full information about the rates of paid services
  • Contact the Operator for technical support and consulting

5.2. The User is obligated to:

  • Use the Platform only for lawful purposes
  • Provide only complete, accurate, and truthful information belonging to them
  • Maintain the confidentiality of Personal Account credentials
  • Not allow third parties to use their Personal Account
  • Refrain from actions that could harm the Platform’s operations

5.3. The Operator has the following rights:

  • Temporarily suspend service provision for technical reasons
  • Block access to a User’s profile in case of violation of the Offer terms
  • Unilaterally change service rates (with at least 10 days’ notice)
  • Use User data for statistical analysis

5.4. The Operator is obligated to:

  • Provide services in accordance with the terms of the Offer
  • Ensure the confidentiality of User data
  • Not disclose data to third parties, except as required by law
  • Take necessary measures to ensure Platform security

6. MENTORING SERVICES

  • Through the Platform, the User has the opportunity to access mentoring services from experienced mentors.
  • Mentoring packages are not standardized; each Mentor develops them independently.
  • Only mentoring packages approved by the Operator are visible as active on the Platform.
  • The package includes the package name, description, scope, number of sessions, duration, service period, and price.
  • Payments are made through the Platform’s online payment system using UZCARD, HUMO, VISA, and MasterCard.
  • After successful payment, the User receives a personal message to establish contact with the Mentor.
  • Mentoring services are provided online via Zoom, Google Meet, Telegram, iApply.org chat, and other tools.
  • Complaints are sent to info@iapply.org and are reviewed within 10 business days.

7. PAYMENT PROCEDURE

  • Payments for paid services are made via national and international bank cards.
  • Payments are made in the national currency of the Republic of Uzbekistan.
  • After successful payment, the service is provided immediately or within the specified timeframe.
  • Payments are non-refundable, except in cases provided for by law.
  • The User has the right to receive an electronic receipt or other payment confirmation document.

8. PERSONAL DATA

8.1. The User provides their personal data during registration and when using the services.

8.2. Data subject to processing:

  • First name, last name (patronymic — optional)
  • Phone number
  • Email address
  • Passport details
  • Residential address
  • Educational data
  • Other data related to Platform activities

8.3. Purposes of data use:

  • Providing services
  • Submitting documents to educational institutions
  • Establishing communication with the User
  • Statistics and analysis
  • Fulfilling legal requirements

8.4. Profile data is retained for as long as the user account is active; applications and documents are retained for 5 years after submission.

8.5. Data is encrypted using SSL/TLS protocols and transmitted via secure channels.

9. USER RIGHTS (REGARDING DATA)

  • Access and obtain a copy of their personal data
  • Update or correct inaccurate or incomplete data
  • Request deletion of data
  • Right to restrict processing
  • Right to withdraw consent at any time

10. COOKIES

10.1. The Platform uses the following types of cookies:

  • Essential cookies
  • Functional cookies
  • Analytical cookies
  • Marketing cookies

10.2. The User may decline to accept cookies in browser settings. In this case, some Platform functions may work in a limited capacity.

11. LIABILITY OF THE PARTIES

  • The parties shall be liable for failure to perform or improper performance of their obligations under the Offer in accordance with the law.
  • The Operator is not liable for incorrect data entered by the User, rejection by an educational institution, internet outages, or force majeure circumstances.
  • The User shall be personally liable for any damages resulting from failure to maintain the confidentiality of Personal Account credentials.
  • In case of a service not being provided due to the Operator’s fault, the User is entitled to demand a refund of the amount paid.

12. FORCE MAJEURE

  • The parties are released from liability for failure to fulfill obligations due to natural disasters, wars, epidemics, decisions of government bodies, and other emergency circumstances.
  • The party affected by force majeure must notify the other party within 10 business days.
  • Force majeure circumstances must be confirmed by a competent authority.

13. DISPUTE RESOLUTION

  • All disputes arising between the parties shall be resolved through negotiations.
  • If negotiations fail, the dispute shall be referred to the court at the Operator’s location.

14. TERM AND AMENDMENTS OF THE OFFER

  • This Offer comes into force from the moment it is published on the Platform and remains valid indefinitely.
  • The Operator has the right to unilaterally amend the terms of the Offer.
  • If the User disagrees with the amendments, they may cease using the Platform and delete their profile.

15. TERMINATION OF THE OFFER (DENUNCIATION)

  • The User has the right to unilaterally terminate the Offer at any time by deleting their profile.
  • The Operator has the right to block or delete a User’s profile in case of violation of the Offer’s terms.

16. FINAL PROVISIONS

  • Matters not regulated by this Offer shall be governed by the legislation of the Republic of Uzbekistan.
  • If any part of the Offer is found to be invalid, this shall not affect the validity of the remaining parts.
  • All notifications and messages are sent via the User’s Personal Account or email.
  • By using the Platform, the User automatically consents to electronic document management.
